Terms and conditions of use

These terms and conditions of use govern the use of the Lisbon City Council website. We recommend that you read them before continuing your visit.

1. GENERAL INFORMATION

These Terms and Conditions of Use govern the use of all websites under the lisboa.pt domain and subdomains, owned by CÂMARA MUNICIPAL DE LISBOA, hereinafter CML, including, where applicable, the domains and respective subdomains of companies, organizations, associations or other legal persons integrated into the universe of CÂMARA MUNICIPAL DE LISBOA, which exercise attributions, powers, competences or faculties of CÂMARA MUNICIPAL DE LISBOA and/or which provide services, services or goods through this domain and subdomains or through authentication therein, and which are hereinafter referred to as the Website.

Objectives/Services: The main objective of the CML Website is to offer its users content, news, services, institutional information, among others, and it allows, in its own areas, including in the areas of the lisboa.pt subdomains, the management and provision to the user of services, services and goods integrated in the competences and attributions of the municipality and entities of the municipal universe.

Access to and use of the Website is the sole responsibility of the user, who is subject to acceptance of these terms and conditions of use. Use of the Website, as well as relations between CML and users, are governed by applicable Portuguese law.

CML reserves the right to amend these terms and conditions of use whenever deemed necessary.

If you do not agree to these Terms and Conditions of Use, do not use the Website. The Terms and Conditions of Use and the Privacy Policy constitute a contract between you and CML and apply to your use of the Website. It is your responsibility to read and review them each time you access the Website, so that you are aware of any changes made.

2. WEBSITE CONTENT / INTELLECTUAL PROPERTY

" Website content" means all the information on the Website, including text, images, photographs, videos, illustrations, graphic design and web design.

All content is protected by the Code of Copyright and Related Rights, and by the Industrial Property Code, under Portuguese and European Union laws, international conventions and other laws, and may not be used outside the conditions allowed on the Website and without the consent of CML.

The contents of the Website, or any other intellectual property rights contained therein, are the property of CML and their use by unauthorized third parties is expressly prohibited. The content of the Website is provided for information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, sold, licensed or otherwise exploited for any other purpose without the prior written consent of its owner. The user declares not to use, disable or interfere with security-related features of the Website.

The user may, however, print material contained on the Website, provided that it remains unchanged, is for personal and non-commercial use, and that the source and copyright are indicated.

Nothing on the Website should be interpreted as granting any kind of license or other authorization for use to its users.

The Website may contain images or other materials whose copyright belongs to third parties, such as suppliers or other entities that contribute to their creation or maintenance (such as photos from the image bank).

Although the personal data provided to CML is covered by the privacy policy, any information or other content that the user transmits through the Website, whether by email, sending files or otherwise, will be considered freely accessible and therefore non-confidential information.

3. CONTENTS AND GUARANTEES

The user agrees that use of the Website is at the user's own risk. To the fullest extent permitted by law, CML disclaims all warranties, express or implied, with regard to the use of the Website. CML does not guarantee the correctness or accuracy of the content provided on the Website, and assumes no responsibility or liability for:

  1. errors or inaccurate content;
  2. personal injury or property damage of any kind resulting from access to and use of the Website;
  3. unauthorized access to or use of our secure servers and/or personal information;
  4. interruptions or cessation of transmission to or from the Website;
  5. errors, viruses, trojan viruses or similar which may be transmitted to or via the Website;
  6. errors or omissions in content or any loss or damage incurred as a result of the use of content published, uploaded, transmitted or made available through the Website;
  7. unavailability or any difficulty or inability to download or access content or any other communication system failure that may result in the Website being unavailable.

CML reserves the right to make changes and corrections, change the name, suspend or close the Website when it deems appropriate and without prior notice to users.

4. EXCLUSION OF LIABILITY

CML does not control or manage the information, products or services of the content provided by third parties on the CML Website, as well as the hyperlinks to other websites on the Internet, and is therefore not responsible for any errors of any kind or any incorrect data on these websites and their content, including their privacy policies and practices.

The inclusion of content provided by third parties and hyperlinks on the Website does not imply acceptance by CML of the content contained therein or an association with their owners. Nor does it imply that CML has any rights over the content of such websites.

Accessing and visiting any of these third-party websites is done at the user's own risk, and the user is responsible for any use and/or the consequences thereof.

CML disclaims any liability for any direct, indirect and/or incidental damages arising out of the use or inability to use the materials contained on the Website, and does not control and is not liable for any unlawful, offensive or defamatory conduct of its users.

The Website is controlled and offered by CML from facilities in Portugal. Anyone accessing or using the Website from other jurisdictions does so on their own initiative and is responsible for compliance with local laws.

The electronic publications contained on the Website are subject to Portuguese law, insofar as it is applicable to them, namely for the purposes of liability for the facts, opinions, articles and comments of duly identified persons or bodies, as well as in relation to the protection of sources and other duties, rights and freedoms applicable to the written press.

5. REGISTRATION

In order to access some of the content and services on the CML website , the user needs to register in the areas designated for this purpose. The user agrees to take responsibility for their login details, such as email address and password.

By registering, the user agrees that:

  1. your registration is personal and non-transferable and may not be used by any other person to access CML's digital content;
  2. you will not do anything that could harm CML, such as accessing an unauthorized area or account and its information;
  3. you will immediately contact CML if you become aware of any unauthorized use of your login details;
  4. will not evaluate and test the vulnerability of the system and break the installed security.

6. USER DUTIES / PROHIBITED USES

The User may download or copy material strictly for personal use, with CML retaining ownership of the respective copyright.

The User undertakes not to attack or unlawfully use CML's systems or Website, and shall be held responsible for and bear all costs associated with any unlawful actions attributed to him/her. Among others, the following are considered to be unlawful actions

  1. accessing an unauthorized area/account and its information;
  2. testing and assessing the vulnerability of the system and breaching the security installed;
  3. installing or attempting to install viruses;
  4. sending unsolicited emails that include promotions or advertising for products or services;
  5. triggering or attempting to trigger"denial of service" attacks (attempts to make a system's resources unavailable to its users).

7. SUSPENSION OR INTERRUPTION OF ACCESS

CML reserves the right to interrupt or suspend access to the Website, for as long as it deems necessary, for any technical, administrative, force majeure or other reasons, and shall not be held liable for any suspension or interruption of access that may occur for reasons not attributable to it or attributable to mere negligence.

8. WARNING

Without prejudice to the commitment to confidentiality (which must be taken as an obligation of means) regarding the use of personal data - privacy policy - CML warns that there are risks related to the Internet and databases, and it is possible that personal data contained on the Website may be captured and/or transferred by third parties, particularly in countries where personal database protection systems are still at an undeveloped stage and where protection is scarce and ineffective. By accessing the CML Website , users must accept the risks inherent to their activity as an Internet user, namely the risk of possible open data transfer.

9. SECURITY AND USE OF INFORMATION

Users of the CML Website declare and guarantee that they are fully aware of the characteristics and constraints, limitations and defects of the Internet, in particular:

  1. that data and information transmissions via the Internet only benefit from relative technical reliability, circulating on heterogeneous networks of different characteristics and technical capacities, which disrupt access or make it impossible at certain times;
  2. any website/portal is subject to intrusion by unauthorized third parties and may consequently be interrupted;
  3. the information circulating on the Internet is not protected against possible misuse;

Access, use, viewing and operation of the Website by the user is at the user's own risk, and the user must ensure that they have the necessary security and confidentiality conditions in place prior to accessing, using or viewing the Website, carrying out any actions or interactions therein, and/or carrying out any communications, as well as to ensure the integrity, security and/or, where applicable, recovery of the equipment and devices used and any information or data contained therein.

The Municipality of Lisbon does not guarantee, does not verify and is not responsible for the compatibility of the Website with the devices or equipment used, the user's browsing, security or privacy settings, the browsers or operating systems used and, in general, the user's software, hardware or firmware, the user being responsible for any download, configuration, update or installation carried out on devices or equipment, of applications, firmware or software, within the scope and for the purposes of accessing the Website.

Users of the CML Website declare and guarantee that they accept the risks inherent in the normal use of the Internet and CML shall in no case be liable for any accidental or voluntary damage, including contamination by viruses, suffered by users and whether or not caused by third parties in the context of the use of the services provided on the Website or elsewhere on the Internet to which they have had access through it.

10. PROTECTION OF PERSONAL DATA

The purpose ofour privacy policy is toinform users of the general rules for processing personal data, which are collected and processed in strict compliance with the provisions of the personal data protection legislation in force at all times, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR).

These "Terms and Conditions of Use" and any rights and licenses granted hereunder may not be transferred or assigned by the user, but may be assigned by CML to third parties without restriction.
